General Terms and Conditions (Terms of Service) – Libéll

Welcome to Libéll! "We", "us" and "our" refer to Libéll. Libéll operates this shop and this website, including all related information, content, features, tools, products and services, to offer you as a customer a curated shopping experience (the "Services"). Libéll uses Shopify as the technical platform for providing the Services.

The following terms (these "Terms") describe your rights and obligations when using the Services. Please read these Terms carefully, as they contain important information about your rights as well as disclaimers and limitations of liability.

By agreeing to these Terms, you confirm that you are at least of legal age. To use the Services, you may need to provide certain information (email, billing, payment and shipping address). We strive to present our products accurately. Colours or appearance may vary depending on your device and screen settings. All product descriptions may be changed at any time without prior notice. We reserve the right to discontinue products or to limit quantities.

3. ORDERS
By placing an order, you make an offer to purchase. Libéll reserves the right to accept or reject orders at its own discretion. An order is only deemed accepted once confirmed by Libéll. Returns and exchanges are handled exclusively in accordance with our Returns and Refund Policy [LINK]. You warrant that your purchase is intended for personal use and not for commercial resale.

4. PRICES AND BILLING
Prices, discounts and promotions may change without prior notice. The price at the time of the order, as stated in the order confirmation, applies. As a small business within the meaning of § 6 (1) no. 27 UStG, we do not charge VAT. The prices shown are final prices including shipping within Austria.

5. SHIPPING AND DELIVERY
We are not liable for delays in shipping and delivery that are beyond our control (e.g. caused by shipping providers). All delivery times are estimates. The risk passes to you when the goods are handed over to the shipping provider.

6. INTELLECTUAL PROPERTY
All content of the Services (trademarks, texts, images, graphics, design) is the property of Libéll or its licensors and is protected by copyright. Use is permitted for personal, non-commercial purposes only. The name "Libéll" as well as its logo and slogans are trademarks of Libéll and may not be used without prior written consent.

7. OPTIONAL TOOLS
Access to third-party tools is provided "as is" without any warranty on our part. Use is at your own risk.

8. LINKS TO THIRD PARTIES
We are not responsible for the content or accuracy of third-party websites that are linked to. Use is at your own risk.

9. RELATIONSHIP WITH SHOPIFY
Libéll uses Shopify to provide the Services. Sales take place directly between you and Libéll. Shopify is not responsible for any aspect of the sale between you and Libéll.

10. PRIVACY POLICY
All personal data is subject to our Privacy Policy [LINK]. As the Services are hosted via Shopify, Shopify also processes such data in order to provide the Services.

11. FEEDBACK
If you submit ideas, reviews or other feedback, you grant us a free, worldwide right to use it. We are not obliged to treat feedback confidentially or to compensate you for it.

12. ERRORS AND INACCURACIES
Occasionally, information (product descriptions, prices, availability) may contain errors. We reserve the right to correct them at any time, including after an order has been received.

13. PROHIBITED USE
The Services may only be used for lawful purposes. Prohibited are, among other things: unlawful use, infringement of third-party rights, distribution of malware, spam, automated reading of the website (scraping, bots, AI agents) without our consent.

14. AGENTS (AI/AUTOMATED SYSTEMS)
Automated systems that access the Services on behalf of third parties must clearly identify themselves as such and must not circumvent any security measures.

15. TERMINATION
We may terminate this agreement or your access at any time without prior notice. Amounts already due remain payable.

16. DISCLAIMER OF WARRANTIES
The Services and products are offered "as is" without warranty, to the extent permitted by law. Statutory warranty rights remain unaffected.

17. LIMITATION OF LIABILITY
To the extent permitted by law, we are not liable for indirect, incidental or consequential damages arising from the use of the Services or products.

18. INDEMNIFICATION
You indemnify Libéll against third-party claims arising from your breach of these Terms or of applicable law.

19. SEVERABILITY
Should any provision of these Terms be invalid, the validity of the remaining provisions remains unaffected.

20. WAIVER; ENTIRE AGREEMENT
Failure to exercise a right does not constitute a waiver. These Terms constitute the entire agreement between you and us.

21. ASSIGNMENT
You may not transfer this agreement without our prior written consent. We may transfer our rights and obligations without consent.

22. GOVERNING LAW
These Terms are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is the registered seat of Libéll in Austria, to the extent permitted by law. Consumers may also rely on the mandatory protective provisions of the country of their habitual residence.

23. HEADINGS
Headings are for convenience only and do not affect the interpretation of these Terms.

24. CHANGES TO THESE TERMS
We reserve the right to update these Terms at any time. Changes will be published on our website. Continued use of the Services after changes have been published constitutes acceptance.
